LAF specializes in the manufacture and distribution of medical devices for dental use, with a particular focus on made-to-measure dental alignment equipment.

As part of its business, LAF publishes the website www.praticiens.aligneursfrancais.com, which enables LAF to promote its medical devices.

1. DEFINITIONS

The following definitions apply to the entire TOS.

  • ” Practitioner“means any LAF partner Dental Surgeon or Orthodontist.
  • ” GCU“means these general terms and conditions of use.
  • ” LAF“refers to the simplified joint stock company LAF, with a share capital of 2,400 euros, having its registered office at 10 rue de Penthièvre in Paris (75008) and registered in the Paris Trade and Companies Register under number 878 011 857.
  • ” Material“means any medical device for dental use sold by LAF, in particular any custom-made dental alignment equipment.
  • ” Online Services “means the information services provided by LAF to Users via the Site.
  • ” website“refers to the website accessible at www.aligneursfrancais.com and all its sub-domains.
  • ” Treatment“means any orthodontic medical treatment provided by a Practitioner.
  • ” User“means any Internet user browsing the Site and/or using the Online Services.

Unless otherwise required by the context, definitions in the singular include the plural, and vice versa.

2. purpose of the terms and conditions

The purpose of the GCU is to govern browsing on the Site and the conditions under which Users may access the Online Services free of charge.

The GCU do not govern the relationship between the User and the Practitioner. Responsibility for Processing lies exclusively with the Healthcare Professional since, in publishing and operating the Site, LAF merely provides digital services.

3. Acceptance of T&Cs

By browsing the Site and using the Online Services, each User is deemed to have read and accepted the GCU as in force at the time of browsing and/or using the Online Services.

In the event of disagreement with all or part of the GCU, the User undertakes not to use the Site or the Online Services.

4. COMMITMENTS OF LAF

LAF undertakes to make the Online Services available to Users via the Site and to use its best efforts to ensure their accessibility and proper operation.

In this respect, LAF undertakes to ensure that the Site and Online Services are available 24 hours a day, 7 days a week, except in cases of force majeure or unforeseeable and insurmountable behaviour by a third party, and subject to any breakdowns and/or maintenance operations necessary for their proper operation.

The User is informed and accepts that, due to the specific characteristics of the Internet and telecommunications networks, LAF cannot guarantee permanent availability of the Site and Online Services. In the event of malfunction or anomaly, LAF will make its best efforts to restore the situation.

4.1 Hardware information

LAF provides information about the equipment.

LAF makes every effort to provide reliable and error-free information, but cannot guarantee the accuracy of every piece of information on the Site.

4.2 User support

After making an appointment with a Practitioner, LAF undertakes to contact the User, which the User expressly accepts, to present the Equipment and the ordering process.

Throughout the Processing, LAF undertakes to contact the User, which the User expressly accepts, to ensure follow-up.

5. User commitments

The User undertakes to use the Site in accordance with its intended purpose, to honour appointments made via the Online Services and to refrain from any behaviour likely to prevent the continuity of the Online Services or the Site.

More generally, the User undertakes to comply with the laws and regulations in force and not to infringe public order, public decency or the rights of third parties, nor to violate any legislative or regulatory provision.

6. LIABILITY

LAF’s role in providing Online Services and publishing the Site is limited to providing digital services.

The User understands and accepts that Treatment is the sole responsibility of the Healthcare Professional who is responsible for the medical acts performed. Furthermore, use of the Online Services in no way alters the obligations of the Centers and Healthcare Professionals towards Users.

In this respect, LAF cannot be held liable in any way whatsoever for damage suffered by the User as a result of a Treatment, which is the exclusive responsibility of the Center or the Healthcare Professional.

7. intellectual property

The Site and all of its components, including but not limited to the trademark “Les Aligneurs Français” registered with the INPI, software, databases and content of any kind are protected by the intellectual property rights in force and remain the exclusive property of LAF.

The GCU and/or the use of the Online Services do not transfer any intellectual property rights, and the User is in no way authorized to use the data contained on the Site.

10. Applicable Law and JURISDICTION

The GCU are governed and interpreted by French law.

Pursuant to article R. 631-3 of the French Consumer Code, the consumer may choose to bring an action not only before one of the courts having territorial jurisdiction under the French Code of Civil Procedure, but also before the court for the place where he or she lived when the contract was concluded or when the harmful event occurred.
